Motion Picture Association and ByteDance Reach Agreement to Strengthen Copyright Safeguards for Generative AI: The Motion Picture Association (MPA) and ByteDance have reached a Memorandum of Understanding (MOU) establishing a shared framework aimed at strengthening intellectual property protections for generative artificial intelligence tools that create videos and images.

The agreement focuses on AI models including Seedance and Seedream, which are offered across ByteDance platforms and services including TikTok, the TikTok USDS Joint Venture, CapCut and Dreamina, among others.

The MOU marks a significant development in the growing debate over copyright protection, artificial intelligence and the use of creative content to develop and operate generative AI systems.

Agreement Follows Earlier Copyright Dispute

The agreement comes after the MPA sent ByteDance a cease-and-desist letter in February concerning Seedream 5.0 Lite and Seedance 2.0. Following the letter, the two organisations entered into discussions focused on strengthening safeguards around intellectual property.

According to the MPA and ByteDance, their recent engagement has resulted in progress on protections incorporated into newer products, including Seedream 5.0 Pro and Seedance 2.5.

The new MOU formalises the framework for continued cooperation as ByteDance’s AI technologies develop.

MPA: Copyright Is a Cornerstone of Creative Industries

MPA Chairman and CEO Charles Rivkin said the agreement demonstrates the organisations’ shared belief that copyright must remain central to the film and television industry.

“Today’s agreement illustrates our belief that copyright is a cornerstone of the film and television industry,” Rivkin said, adding that the MOU reinforces the MPA’s commitment to protecting creative content.

He said the organisations had engaged constructively over recent months to implement meaningful guardrails for Seedance and Seedream, while emphasising the intention to further strengthen those protections.

ByteDance Commits to Responsible AI Development

John Rogovin, General Counsel at ByteDance, said the company respects intellectual property rights supporting creative industries worldwide.

“Responsible innovation in AI goes hand in hand with meaningful protections for rightsholders,” Rogovin said.

He added that ByteDance valued its engagement with the MPA and its members and would continue strengthening safeguards across its generative AI services.

The MOU is intended to provide a framework for continued collaboration across multiple ByteDance products and platforms as AI technology evolves.

Growing Importance of AI Copyright Protection

The agreement comes at a time when generative AI has become a major focus for the global entertainment and media industries. AI-powered tools can increasingly generate sophisticated video, images and other creative material, raising questions about copyright ownership, unauthorised use of creative works, licensing and protection of artists and studios.

For Hollywood and other content industries, the development of effective safeguards has become an increasingly important part of the broader AI conversation.

The MPA represents major film and television companies, including Netflix, Paramount Pictures, Prime Video and Amazon MGM Studios, Sony Pictures, Universal Studios, The Walt Disney Studios, and Warner Bros. Discovery.

A Framework for Future Cooperation

The MOU does not signal an end to discussions surrounding AI and intellectual property. Instead, it establishes a framework through which the MPA and ByteDance can continue working together as generative AI capabilities evolve.

Both organisations said they intend to continue cooperation aimed at protecting creative content across markets worldwide.

The development could also become a significant reference point for the wider technology and entertainment industries as companies seek to balance rapid AI innovation with copyright protection and the rights of content creators.

For the creative economy, the message from the agreement is clear: as generative AI becomes more powerful, strong intellectual-property safeguards will increasingly become a fundamental part of responsible AI development.
